As I see it:
DVD passed by the BBFC, no worries, even Elfen Lied ;)
Manga on sale in high street shops such as waterstones, no worries.
DVD released in the USA, very unlikely to have a problem.
Manga from a reputable publisher (viz, tokyopop etc..), very unlikely to have a problem.
Import from Japan... this is how Christopher Handley got found, but then they found 7 books from over 1000 and now its down to just 1 image.
Download... always has been at your own risk.

Selling is certainly outlawed, and the same may well apply to importing (as it does in America).

I should add, however, that mere possession of "obscene" material was not illegal per se until the arrival of the CJB.
As I understand the 1964 Obscene Publications Act, possessing obscene material only violates the law if one possesses it "for publication for gain".
 
Received a "bath poster" of a character from Key's upcoming Kud Wafter with this month's Dengeki G's magazine.

Statutory Interpretation, my friend.

There are 3 (Arguably 4) rules that our courts use to interpret legislation;

1) The Literal Rule - Every word is given it's ordinary, plain, grammatical meaning throught the act.

2) The Mischief Rule - Judges look to the preamble of the act, and compare with the law to see what the intention of Parliament was.

3) The Golden Rule - The same as the literal rule, but in the event on an "absurd result", special meaning may be put on a term.


It's highly unlikely that a judge will interpret such an act under the literal rule these days. You don't get many good, old fashioned judges that believe in the Separation of Powers. Most will use the Mischief rule, and have you seen guilty due to the fact you were viewing it. (That's my thought on the matter, anyway).
 
The best part is that Labour rushed this and the Digital Britain Act through before the Election because I grantee they probably couldn't get these two acts done after May 6th.

Of course, all this is has done is grantee that I never vote Labour ever again (Not that I did previously) and view anyone who openly admits to voting them after May 6th to be a gigantic Jackass of the highest order.

I'm fine with the ideas of these laws but I grantee the application is just not going to work in a manor that makes any sense.

But oh well, that's our Gordon Brown!
 
Really disappointed the bill went through. Can't say I've ever wanted to look at loli or the like, but it's a blurry line they've set out here.

The thought you could face jail time over owning or possibly even looking at a drawing that's deemed 'underage' by the powers that be bothers me more than a little. I also doubt this will have any real impact on the conviction of sexual offenders, accept maybe putting a few hentai owners behind bars - and honestly, locking someone up over possession of some dirty drawings is a pretty weak excuse.

Guess I'll have to be careful where I read Berserk from now on...
 
But this law barely restricts anything to do with child pornography. Nearly everything that this restricts is drawings (e.g anime, which contain characters who look under 18 ) and pictures edited with photoshop to look younger.

Under the new law you can be arrested for owning a drawing of a naked 18 year old (if someone decides they look under 18 ) where you could legally own a photograph.
 
Because, as distasteful as the images that are now illegal to possess might be, there's no proof that they do any harm. It may, in fact, make things worse. Violent games will be next. Still no big deal?

I think Britain is going the way of China with it's censorship. Another thing which is bugging me is that alot of anime nowadays has quite a bit of fanservice, and alot of anime nowadays has loli's so i think for us anime fans actually viewing some manner of loli fanservice will be unavoidable.

I know... It's commercial law that every H-game has to have 1 loli character... They aint gonna get one up on me just for 1 character. (Damn you Kamyu-chi!!!)
 
Its bit strange that you can have sex at 16 but it illegal to film it until your over 18, its a bit of barmy type of law. You would think they would lower it to 16 for comics with this law introduced to give some leave-way of decided what allowable or not. With It common for people to have sex ages a lot lower than 16 as well.

The law should be OK as long they don't become over zealot with it. Hopeful not end some silly conviction for reading Negima. But sadly there still a chance something silly could happen though as others had moments of madness before with over zealot laws:
