Subsection (1) creates a new offence in England and Wales and Northern Ireland of possession of a prohibited image of a child.

I don't see anything about scotland
Proceedings for an offence under subsection (1) may not be instituted—

(a)in England and Wales, except by or with the consent of the Director of Public Prosecutions;

(b)in Northern Ireland, except by or with the consent of the Director of Public Prosecutions for Northern Ireland.
I think it means they don't have to go through a higher authority here to prosecute, or something like that.
 
One thing i did notice with this is that it seems to be about the 'owning' of child porn, this could be exploited greatly as far as i know simply viewing and image or video is not being in possesion of it.

It depends. When you view an image, it is generally downloaded to your cache and you therefore do posses a copy of it. There have been cases of people having stuff found on their computer despite not actually specifically saving anything. The images were found in their cache.

Just wondering what age constitutes a CHILD in his law? Is it below 16 I guess? There are some obvious anime character that look well below 16 but there seems to be many broader line cases to where they meet criteria being allowable or Not. With them being imaginary who to say how old the character are.

What's stop someone making a series with clearly well under-age characters designs but with the story making sure to state saying they all over 16?

I wonder what you can get away with under the argument of "artistic value"? You could easily find doujinshi that I would consider very artistic, not least those of a certain Mr. T. Taka, but that also contain one or two images of clearly underage girls.

That's exactly how the Yanks distribute Eroge. The problem with UK law is that what counts as an image of a child seems to be based on nothing but the opinion of law enforcement officers, which is the same reason Australia has recently clamped down on naked images of flat chested women. When will the madness end?

Under 18.

(6) Where an image shows a person the image is to be treated as an image of a child if—

(a) the impression conveyed by the image is that the person shown is a child, or

(b) the predominant impression conveyed is that the person shown is a child despite the fact that some of the physical characteristics shown are not those of a child.

So the character could be 3000 years old for the purpose of the story, but if they look under 18 it matters not a jot.

It's difficult to say. The government have stated that they're targetting the very worst images ("grossly offensive, disgusting or otherwise of an obscene character") but the way the bill was worded leaves much room for subjective interpretation.
 
The critics say that the bill would outlaw such works as Alan Moore's The Lost Girls comic.

Its been illegal to sell or import obscene drawings involving minors for a very long time. Infact anything classed as 'pornography' is generally restricted to sale only in licensed sex shops.

So the fact that the lost girls is on the shelves in the likes of Waterstones indicates it is not porn and thus can't be covered by this bill in the first place.
 
in all seriousness though, i don't think the average anime fan has anything to worry about.

it seems to me that it's just a law that's been passed to help convict known pedophiles

look at the US

the same kind of law has been in power for 5 years now, and since then, only 1 otaku has ever been convicted, and even then people are fighting to get him released.
