Mardock Scramble to be cut by BBFC?

Now that is a brave move as the protagonist is a 15 year old girl who spends much of the first part naked. She is also depicted having sex with an adult, and in a flashback you see her aged 12 having sex with her father. I would assume that the "dangerous cartoons" provisions of the C&JA 2009 Section 62 would not be an issue here because of the "context" exemption granted by Section 62(4) - it's clearly an action thriller with significant sexual content rather than a porn movie with action scenes.

Why.. why would you risk this one?

Because they believe it will stand up as a legitimate, artistic, movie. And it should, from everything I understand about it.

Because they believe it will stand up as a legitimate, artistic, movie. And it should, from everything I understand about it.

1. The character is naked but not in a sexualized situation for the first part of the film.

2. The scene of the 12 year old having sex with her father is a scene of child abuse and the version I saw covered it actually pretty tastefully. There are two versions though - International Cut and Domestic though. The International one played at Leeds Film Festival with no controversy last year and I plan to run both parts at Scotland Loves Anime in October.

Seems to me like people are getting all hot under the collar at the concept of a ban as opposed to just waiting to see. The original post even points out that it doesn't fit the clause in question and it isn't even at the BBFC yet...

Lots of anime feature naked teens/children. This is only seems to be an issue if something sexual is going on at the same time (ie breast fondling/comparing size) that the audience is meant to be aroused by.

From what Andrew is saying it should be fine.
 
It'll be fine, if the BBFC can pass Elfen Lied, which has a scene that strongly implies repeated sexual abuse of one of the characters, then they've got no excuse to cut this.

I remember catching part of a dramatised documentary many years ago my parents were watching but trying to stop me seeing about a girl who was abused, and I remember seeing the mother lying back on her bed, beckon her girl over and push her head down between her legs. This was on British TV.
It's not like it is glorifying rape and child abuse; the whole story is about Rune escaping a life of prostitution and getting revenge on her pimp stroke murderer.
 
Wait, if Mardok Scramble got played in a cinema, it must have been rated, right? This is a non issue.

You can show stuff in cinemas (e.g. at a festival or a one off showing) without being classified by the bbfc. local councils can also override BBFC decisions for their areas. it's not the same as on home video where it's illegal to sell it without a certificate.

So, you can freely show something to a large amount of people. Some of which might be kids who snuck in...

Depending on its content, chances are it'll boil down to how "worthy" the BBFC judges it to be. As a light hearted action series, Ikki Tousen would not be deemed "worthy" and was therefore open to cuts. It's aimed at the mindless proles who will obviously go on a paedophillic rampage at the slightest provocation. On the otherhand , Mardok appears to have a more serious tone and less mainstream appeal, and therefore may get away with more. Art house films and films with very niche appeal have a habit of getting away with things, especially with regards to the content here, that would almost certainly get cut in a production with a mainstream target audience. It's elitest ******** quite frankly.
 
If she is depicted as being about 15 it wouldn't necessarily be breach of the bbfc's policy on "teen" porn even if the scene wasn't judged by the bbfc to be artistically justified.

As an aside vertical released the manga Lychee Light Club by Usumaru Furuya and they are going to release Velveteen and Mandala by Jiro Matsumoto, they haven't run into any trouble with those works and both of them contain sexually explicit underage sex.
